O R D E R

% 23.05.2018 CA 271/2018 This application is filed by the respondent for modification of the order dated 14.7.2017. It has been pleaded in the application that what was to be deposited by the respondent in court was a sum of Rs.8,00,000/- and not Rs.9,11,904/-.

None has appeared for the petitioner despite service. I may note that the order dated 14.7.2017 of this court states as follows:- "The amount which the petitioner alleges is due against the respondent is Rs.8.00 Lac. As agreed, the learned counsel for respondent intends to deposit an amount of Rs.9,11,904/- towards the principal and interest with the Registrar General of this Court - which may be kept in FDR. Since the claim of the petitioner is for payment of money & since it has now been secured - the parties have thus agreed to agitate their disputes in the Civil Court....."

It is manifest that what the petitioner alleged was that the respondent has to pay is Rs.8,00,000/-. Accordingly, it was intended that the sum of Rs.8,00,000/- lac is to be deposited with the Registrar General of this Court.

The third line of the above order stands modified. Respondent shall deposit Rs.8,00,000/- with the Registrar General of this Court which shall be kept in a FDR.

Application stands disposed of.
