O R D E R

% 20.11.2018 This Court per order dated 21.08.2018 while dismissing the petition, issued notice to the limited extent of extending the time for vacation of the tenanted premises.

The learned counsel for the petitioner seeks two years period for vacation, which is objected to by the learned counsel for the respondent.

After negotiating, both the parties have agreed that tenant be allowed to remain in possession till 30.11.2019 on payment of damages / mesne profits @ Rs.10,000/- per month from the date of the eviction order. The arrears of mesne profits / damages shall be paid within four weeks from today through demand draft in favour of the respondent. The affidavit/undertaking to this extent be filed by the petitioner within two weeks from today.

Learned counsel for the petitioner on instructions undertakes that the petitioner shall not raise any objection of any nature against the eviction order dated 06.01.2018.

With the above observation, the petition stands disposed of. Order dasti to both the parties.
