% 13.05.2016 Vide office order dated 24th October, 2014 , business of the petitioner, a Class - V Contractor registered with the respondent no. 1 was suspended during the pendency of inquiry and final outcome of the case, in terms of Section 23.1 of sub-clause (e) of the Enlistment Rules. Petitioner has challenged this office order in this writ petition. During the course of hearing, learned counsel for the respondent nos. 1 and 3 has pointed out that inquiry has been completed, inasmuch as petitioner has been demoted from
Class - IV/Civil to Class - V/Civil under Section 23.1 of sub-clause (e) of the Enlistment Rules dated 2nd March, 2012, vide Circular No.
ADC(Engg.)/NDMC/2016/D-700 dated 1st March, 2016 and a photocopy thereof has already been sent to the petitioner. Learned counsel for the petitioner submits that no such circular has been served on the petitioner. Counsel for the respondent nos. 1 and 3 has supplied a copy of the circular to the counsel for the petitioner. In view of this, learned counsel for the petitioner submits that present writ petition is not being pressed, as petitioner would be challenging the said office order/circular dated 1st March, 2016. She seeks leave to withdraw this writ petition with liberty to file a fresh petition. Writ petition is disposed of as not pressed. Miscellaneous application is disposed of as infructuous. A.K.
