% 02.05.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the application filed therewith seeking liberty to move an application under Order XXXIX Rule 4 of the Code of Civil Procedure, 1908 (CPC) before the trial court for the ad interim temporary injunction to be varied and modified, in case the petitioner intends to part with any portion or create any third party interest in respect of the suit property.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
