% 27.02.2017 The matter was directed by order dated 22.09.2016 to be re-notified on 24.02.2017, which by the calendar of the court subsequently issued, was declared to be a holiday followed by 25.02.2017 Saturday, a non court working day and 26.02.2017 being Sunday. Hence the case is taken up today.

The plaintiff's counsel submits, on instructions, that he wishes to withdraw the present suit inasmuch as the sale deed has already been executed by defendants No.1,2 and 3 in favour of the plaintiff thereby satisfying the claim, defendant No.4 being described by both counsel as a proforma party.
