The order highlights that the registered owner of the vehicle in question is : Sameer Bhalla, the complainant. The order notes that seeking quashing of the summoning order reliance is on certain facts which need to be proved at the trial.

In para 5 this has been specifically noted. The appellant had filed a suit which was dismissed has also been noted. Appeal filed by the petitioners against said order has also been noted. It has been observed that if the appeal succeeds its impact would be considered by the learned Metropolitan Magistrate.
