% 09.11.2017 Learned counsel for respondent no.1 submits that respondent no.1 will not pursue the complaint under Section 138 Negotiable Instruments Act, 1881 (hereinafter 'the Act') against the petitioner (accused no.4 before the trial court) and the same may be quashed qua the petitioner.

Accordingly, complaint under Section 138 of the Act is quashed qua the petitioner only.

Petition is disposed of in above terms.
