W.P.(CRL) 2606/2016 Issue notice. Notice is accepted on behalf of the State. Ms. Rao has tendered in court the latest nominal roll dated 05.09.2016. The petitioner has preferred this petition to seek parole to attend his ailing mother and to re-establish ties with the society. The petitioner was convicted in case FIR No.224/1997 u/s 452/392/506-II/304 IPC registered at PS Greater Kailash. He was awarded 5 years rigorous imprisonment with fine. His appeal was dismissed by this court on 17.07.2015.

The nominal roll shows that the unexpired portion of the sentence is one month and 12 days. The jail conduct of the petitioner has been reported to be satisfactory. His parole application is pending before the Lt. Governor and the same has still not been decided. It appears that the said application may not be decided before the remaining sentence runs out. In these circumstances, looking to the fact that the petitioner has served most of his sentence and his jail conduct is satisfactory, the petitioner is directed to be released on parole for a period of three weeks subject to his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the trial court. He shall surrender at the end of the parole period to undergo the remaining sentence.

Petition stands disposed of. Dasti.
