% 13.09.2017 CO.PET. 312/2015 & CA No. 1504/2017 The learned counsel for the respondent states that vide order dated 24th July, 2017, though the petition was admitted but the publication of the citation and appointment of Provisional Liquidator was deferred and an opportunity was given to the respondent company to pay the amount due to the petitioner with interest @ 8% per annum with effect from 29th March, 2015.

The learned counsel for the respondent company has moved an application (CA No.1504/2017) with a prayer for condonation of delay of 12 days in compliance of order dated 24th July, 2017 and that they have handed over a demand draft of Rs.6,18,511/- (bearing no. 125539, dated 1.9.2017, drawn on Oriental Bank of Commerce, Sector-17, Gurugram Branch) in full and final settlement in respect of all claims. The delay is condoned.

Learned counsel for the petitioner accepts the said amount in full and final settlement.

In view of above, Co.Pet. No.312/2015 stands dismissed as satisfied.
