MAC.APP. 500/2017 and CM No.20532/2017 The learned counsel for the appellant submits that though the appeal raises certain other contentions, as now instructed, he presses it only to seek premature release of the amount which has been put in the fixed deposit by the Tribunal.

After some hearing, the learned counsel submitted that as now instructed he may be allowed to withdraw the appeal with liberty to approach the Tribunal for requisite relief for immediate release of the amount which have been put in the fixed deposits with the rider of they being released on monthly basis in small amounts, his submission being that he had incurred huge expenditure on medical MAC.APP. 500/2017

treatment by raising finances which liability has to be immediately taken care of.

The appeal and the pending application are dismissed as withdrawn with liberty as prayed for.
