% 18.10.2016 Learned counsel for petitioner submits that petitioner is neighbour of prosecutrix and is aged about 19 years. Petitioner is in custody for about two months. Prosecutrix was known to petitioner and in fact was in touch with him on his mobile phone.
Petitioner is not required for any investigation. Trial is likely to take time. Prosecutrix called the petitioner to his house, after making a call on his mobile phone and when he reached there he was beaten by the four boys present there resulting injuries to the petitioner. Petitioner has been falsely implicated. Learned additional public prosecutor submits that prosecutrix is aged about 13 years. Petitioner is neighbour of prosecutrix. In the middle of night, petitioner went to the house of prosecutrix through the roof and
molested her. On raising alarm, prosecutrix's father came there and caught the petitioner. Petitioner was beaten by the public persons, who gathered at the spot on hearing the commotion.
Keeping in mind the totality of facts and circumstances, it is ordered that petitioner be released on bail subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of trial court.
