O R D E R

% 28.09.2016 Complainant Bhupender Singh has died after disposal of complaint case and during pendency of appeal.

Legal heirs of complainant were brought on record in appeal and have also been impleaded as respondent nos.2(i), (ii) & (iii).

Pursuant to order dated 19th November, 2014, petitioner has submitted the FDR of `2,00,000/- drawn on Punjab National Bank in the name of Registrar General of this Court. Petitioner has offered to pay this amount (lying in the form of FDR) together with interest accrued thereon to the respondents.

Learned counsel for respondent no.2 submits that offer of petitioner is acceptable to the respondents and offence under Section 138 of the Negotiable Instruments Act may be permitted to be

compounded.

Accordingly, offence under Section 138 of the Negotiable Instruments Act is permitted to be compounded and petitioner is acquitted, subject to encashment of FDR and release the amount together with interest accrued thereon to respondent no.2(i) namely Smt. Sant Dasi. It is submitted that respondent nos.(ii) & (iii) have no objection in case the amount is released to their mother namely Smt. Sant Dasi.

It is noted here that name of Smt.

Sant Dasi has been wrongly mentioned as Smt. Sant Devi in the memo of parties.

Correct amended memo of parties be filed during course of the day.

Registry to encash the FDR and release the payment to respondent no.2(i) namely Smt. Sant Dasi.

Petition is disposed of in the above terms.
