% 25.01.2017 By this application, petitioner seeks interim bail for 30 days for taking care of his ailing mother. It is submitted that mother of the petitioner has undergone surgery on 8th February, 2016 at Max Cancer Centre, thus, she requires post surgery care. It is further submitted that doctor has advised petitioner's mother for adjuvant chemotherapy with Epirbicinn along with Cyclophosphamide injection.

Status report has been filed which discloses that petitioner's mother is living with her elder son (elder brother of petitioner), namely, Hazi Afzal along with other family members. It is further mentioned that wife of Hazi Afzal is a local counsellor of Seelampur area. It is submitted that brother of

petitioner is capable of taking care of his mother. In facts and circumstances of the matter, application is dismissed. A.K. PATHAK, J.
