O R D E R

% 12.05.2017 I.A. No. 2760/2017(u/O XXIII Rule 3 CPC) Parties have settled their disputes. The settlement deed is annexed with the aforenoted application which is signed by the parties. The application is duly supported by the affidavits of constituted attorney of the plaintiff, defendant No.1, constituted attorney of defendant No.2 as also by the affidavits of defendant Nos. 3, 4 and 5. Parties shall be bound by the terms and conditions contained therein which have been specifically delineated in para 5 of the said application.

Suit of the plaintiff stands decreed in terms of the aforenoted settlement which has already been marked as Ex.C1 by the Joint Registrar.

In terms of Section 16 of the Court Fee Act, half of the court fee is ordered to be refunded to the plaintiff. Suit and the application stand disposed of.

I.A. No. 10932/2016 (U/O XXXIX Rules 1 & 2 CPC) Since the suit has been disposed of, this application has become infructuous.

It is disposed of, accordingly.
