% 06.12.2018 By this petition the petitioners seek quashing of FIR No.179/2016 under Section 420/34 IPC registered pursuant to the directions of the learned Metropolitan Magistrate under Sections 156(3) Cr.P.C. A status report has been filed under the signatures of DCP South-East District according to which the dispute in the complaint was primarily civil in nature and the respondent No.2 has already filed civil suit claiming damages. It is stated that during the investigation no evidence of any wrongful loss caused to the complainant or wrongful gain caused to the accused or the company came to the notice. Since there was no sufficient W.P.(CRL) 2837/2016
evidence on record for charge-sheeting petitioners under Sections 420/34 IPC, a closure report has been submitted in the Court of learned Metropolitan Magistrate Ms. Ankita Lal, Saket Courts on 1st December, 2018.
Since a closure report has already been filed pursuant to the investigation, no further orders are called for from this Court except that in case any order adverse to the petitioners are passed by the learned Metropolitan Magistrate they would have the liberty to take remedies as available in law.
Petition and applications are disposed of.
