IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4322/2018 KAMLA ARYA & ORS.

..... Petitioners Through Mr. Abhimanyu, Adv with petitioners in person versus STATE AND OTHERS ..... Respondents Through Ms. Manjeet Arya, APP for State SI Ajay Kumar, PS DIU/North Respondent nos. 2 and 3 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 05.09.2018 Notice could not be issued to respondent nos. 2 and 3 as PF was not filed. However, respondent nos. 2 and 3 are present in Court and have been identified by SI Ajay Kumar of DIU/North. Respondent nos.2 and 3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, inasmuch as they have received `2,72,000/- each from the petitioners. They submit that they have no objection in case FIR No. 978/2015 under Sections 420/120B IPC, police station Burari is quashed against the petitioners. A perusal of FIR shows that a dispute arose between the parties over property in question which led to registration of the aforesaid FIR.

Since respondent nos. 2 and 3 have settled their disputes

amicably with the petitioners, in my view, no fruitful purpose would be served in keeping the aforesaid FIR pending. Accordingly, aforesaid FIR pending and the consequent proceedings emanating therefrom are quashed qua the petitioners.

Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J SEPTEMBER 05, 2018 sm
