I.A.No. 9510/2019 under Section 151 CPC read with relevant rules of Delhi High Court Rules filed by the plaintiff for condoning the delay in re-filing of 35 days Heard. Perused. The aforesaid application of the plaintiff is allowed subject to just exceptions.
I.A stands disposed of.
I.A.No. 9509/2019 under Section 151 CPC filed by the plaintiff to condone the delay of 84 days in complying with the directions of the Registry Bill of cost already stated to be filed by the plaintiff. It is submitted by counsel for the plaintiff that the Bill of Costs could not be filed by the plaintiff within time as prescribed in Delhi
High Court (Original Side) Rules, 2018 due to the reasons as mentioned in the aforesaid application and delay in filing the Bill of Costs by the plaintiff be condoned and bill of costs be permitted to be taken on record.
Arguments heard on the aforesaid application of the plaintiff. Perused the material available on record. Considering the facts, circumstances and in view of the submissions made and in the interest of justice, the aforesaid application of the plaintiff is allowed. Delay in filing the Bill of Costs is condoned.
Aforesaid IA stands disposed of.
CS(OS) 341/2017 Registry is directed to prepare bill of costs and file the same on or before the next date of hearing.
At request, re-notify the matter for consideration/further proceedings on 16th April, 2020.
