O R D E R

% 24.08.2018 Learned counsel for the petitioner submits that petitioner had worked as Senior Resident in the Northern Railway Central Hospital from January, 2017 to June, 2018. During this period, every month pay and allowances used to be credited in his account by the Northern Railway Accounts Department. No salary slip was being issued to the petitioner during this period. Petitioner had not conspired with co-accused Bharat Dhupar, who was senior clerk in the accounts department. It is contended that petitioner had not asked Bharat Dhupar to transfer alleged excess amount in his account, inasmuch as, petitioner has already returned the excess amount of `5,76,381/- to the Northern Railway Account Department. Accordingly,

petitioner may be extended benefit of anticipatory bail. Learned APP submits that petitioner had conspired with Bharat Dhupar pursuant whereof excess amounts were credited in the account of ten persons including petitioner.

Investigations are going on, therefore, custodial interrogation of petitioner is required. Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of ₹10,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station.

However, petitioner shall cooperate in the investigation and appear before the Investigating Officer as and when he is called upon to do so.

Bail application is disposed of in the above terms. Dasti.
