% 20.03.2019 After some hearing, the counsel for the petitioner submitted that he may be permitted to withdraw the present petition, the petitioner reserving the right to approach the court of Metropolitan Magistrate where the case arising out of report (charge-sheet) under Section 173 of the Code of Criminal Procedure, 1973 (Cr.P.C.) in relation to FIR no. 169/2014 of police station Shahdara is still pending by appropriate application for initiation of complaint under Section 195 read with Section 340 Cr.P.C. qua the offence under Section 211 IPC.

The petition and the pending application are dismissed as withdrawn. The petitioner's application under section 195 Cr.P.C, if moved, shall be considered by the concerned criminal court in accordance with law. R.K.GAUBA, J.
