% 14.08.2018 The present appeal is directed against the order dated 05.04.2017 passed by the Family Court by which the ad-interim injunction has been granted in favour of the wife.
The respondent-wife has filed the suit for permanent injunction read with Section 7(1)(d) of the Family Court Act. Along with the suit an application for interim relief was filed. The Family Court by the impugned order has stayed further proceedings before the Court at Singapore. The marriage between the parties was solemnized on 30.10.2009 at Delhi. Thereafter on account of marital discord the appellant herein filed a petition for grant of divorce on 21.08.2014 at New Delhi. During the pendency of this petition for grant of divorce the appellant herein moved the Court at Singapore also to seek divorce in petition No.13/2016. Thereafter, the petition filed at Delhi was withdrawn on 02.06.2016. The respondent claims to have permanently shifted back to Delhi as visa was revoked by the husband. After some hearing in the matter, it is agreed that the first divorce petition filed by the husband in Delhi Courts would be revived. It is also agreed that the
divorce petition instituted in the Court at Singapore would be withdrawn. Parties shall appear before the concerned Court on 22.10.2018 when written statement will be filed within four weeks from today. Rejoinder would be filed within one week thereafter.
With these agreed directions, the appeal and pending applications are disposed of. The rights and contentions of both the parties in the divorce petition are left open.
