% 31.07.2017 Matter was passed over during the pre-lunch session and is now again taken up after the post-lunch sessions. Ld. counsel appearing for the petitioner states that he is only a proxy counsel and has no instruction from the counsel for the petitioner or the petitioner. Instant writ petition was filed alleging unauthorized construction in the properties bearing no. 47 and 65, Babu Park, which finds mention in para 3(iii) of the writ petition, whereas, the prayer clause is totally silent.

Be that as it may, Mr. Aroraa, Ld.

counsel for the respondent no.1 submits that the property of the applicant stands regularized inasmuch as, as of now, there is no unauthorized construction, and, as for property no. 47, demolition order was passed sometime in May, 2015 and there-against,

owner/builder has preferred an appeal before AT, MCD and that is pending adjudication.

In the given factual conspectus, the instant petition does not survive and is disposed off accordingly.
