The first application, being: CM No.173/2016 is moved by the following four applicants for impleadment as respondents in the writ petition:- (i).

Smt. Sheetala Devi, wife of Late Jugal Kishor Saxena (ii).

Suprabhash Saxena, son of Late Jugal Kishor Saxena (iii). Avinash Chandra Saxena, son of Late Jugal Kishor Saxena (iv).

Devesh Kumar Saxena, son of Late Jugal Kishor Saxena 2.

This application is not maintainable in view of the fact that the writ petition was dismissed for non-prosecution on 15.09.2015. The application, being: CM No.173/2016 is, accordingly, dismissed. 3.

Resultantly, the application filed for condonation of delay in refiling, being: CM No.174/2016 has been rendered infructuous. W.P.(C) 4621/2015

The same is accordingly dismissed.
