HON'BLE MR. JUSTICE R.K.GAUBA

O R D E R

% 09.10.2018 The counsel present for the petitioner submits, on instructions from the main counsel representing the petitioner, that he may be permitted to withdraw the present petitions, the petitioner reserving her contentions set out in the petitions touching upon the merits of the defences to be agitated at appropriate stage in the event of the police filing a charge-sheet initiating any criminal action against her pursuant to the FIR nos. 574/2014 and 575/2014 which have been registered by P.S. Greater Kailash in the wake of directions of the Metropolitan Magistrate by the impugned orders dated 18.10.2014 in the complaint cases CC Nos.124/1A/14 and 223/1A/14 at the instance of the second respondent.

CRL.M.C. 2011/2015 & 2022/2015

The counsel, however, submits that it may be clarified that the anticipatory bail order granted on 09.10.2015 separately in the context of the said two FIRs will continue to inure to the benefit of the petitioner even after withdrawal of these petitions.

It is noted that by similar orders passed on 09.10.2015, in present proceedings the learned predecessor bench had granted anticipatory bail orders to the petitioner in the context of the afore-mentioned two FIRs. The said orders, as recorded, are in absolute terms and will undoubtedly remain available and be operative even after disposal of these petitions. The issues raised by the petitioner are kept open and the contentions may be agitated as defences in the proceedings that may arise after submission of the reports under Section 173 of the Cr.P.C. by the police in the two cases.

The petitions are dismissed as withdrawn. This disposes of the pending applications as well.
