It is submitted by the learned WP(C) 8001/2016

counsel for the petitioner that by order dated 05.09.2016 in WP(C) No.5240/2016 titled Rajeev Kumar Yadav vs. Archaeological Survey of India & Ors., which was a public interest litigation, filed by the petitioner therein, the order dated 13.06.2016, impugned in the present petition, has already been set aside and the competent authority has been directed to pass orders afresh after giving an opportunity to the petitioner herein of being heard. Learned counsel for the petitioner submits that the grievance of the petitioner, raised in the present petition, does not survive as of now in view of order dated 05.09.2016 of the Division Bench. He craves leave to withdraw the petition with liberty to approach this Court, in case the petitioner is aggrieved by the fresh order passed by the competent authority.

The writ petition is dismissed as withdrawn reserving liberty of the petitioner, as prayed for.
