Present petition is filed under section 11(5) and 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties. 2.

The parties entered into an Agreement on 20.12.2012 for development, implementation, operation and maintenance of nonconventional power projects which included setting up of a Greenfield wind farm Project for an aggregate capacity of 51.00 MW located in Devgarh site, State of Rajasthan.

Subsequent amendment took place on 14.11.2013 in the said Agreement.

Disputes having arisen between the parties the petitioner issued a notice dated 13.12.2016 under Article 7 of the Wrap Agreement. Learned counsel for the respondent has no objection to the appointment of an

Arbitrator.

Accordingly, Mr.Koka Raghava Rao, Advocate (Mobile No.9971259053) Supreme Towers, Tower No.10, Flat No.1003, Sector 99, Noida is appointed as an Arbitrator to adjudicate the disputes between the parties. The learned Arbitrator shall comply with Section 12(1) of the Act. He shall fix his fee in consultation with learned counsel for the parties. Parties to appear before the learned Arbitrator on 14.7.2017 at 4:00 PM. 6.

Petition stands disposed of. Copy of the order be sent by the Registry to the learned Arbitrator.
