% 10.04.2017 CM APPL. 39470/2016 (delay of 756 days in re-filing of the appeal)

1. There is an extraordinary delay of 756 days in re-filing of the appeal. The excuse that is given for this delay is the standard one - about the introduction of e-filing system in this Court.

2. As already explained in several orders of this Court, the difficulty if any in that regard was adequately taken care of by the organising orientation sessions for the lawyers on several dates. In any event, the question of there being more than two years' delay in re-filing of the appeal on that score is not acceptable.

3. In the absence of any satisfactory reason for the delay, the Court is not inclined to condone the extraordinary delay of 756 days in re-

filing the appeals. The application is dismissed. ITA 732/2016
