No.32923/2016 Petitioner is aggrieved by the fact that although the Financial Commissioner vide its order dated 03.9.2015 had remanded the matter back to the SDM/Revenue Assistant with a direction to carry out fresh demarcation (as the petitioner before this Court had challenged the demarcation dated 11.5.2015 holding it to be ex parte) yet the SDM/Revenue Assistant is not proceeding with the matter. His further submission is that he is suffering threats at the hands of the Revenue Authorities; his submission is that till the time
demarcation is effected by the SDM/Revenue Assistant no coercive steps (which deemed to be perceived by the petitioner) should be taken.
This position is disputed by the respondent. His submission is noted which is to the effect that till the time demarcation is carried out by the SDM/Revenue Assistant in terms of the order of the Financial Commissioner dated 03.9.2015 status qua shall be maintained. Noting this submission as also the stand of the respondent that the demarcation shall be carried by the SDM/Revenue Assistant within four weeks from today, no further orders are called for in this petition.
Needles to state that the demarcation will be carried out after due notice to the petitioner and in the presence of the petitioner. Petition disposed of.
