% 16.05.2017 Learned counsel for the petitioner submits that since the petitioner is not named in the FIR and his name is also not coming in the Statement of the complainant under Section 164 Cr.P.C and also the name of the petitioner is not included in the charge-sheet, however, the present anticipatory bail application was filed before filing the charge-sheet, in these circumstances the petitioner wishes to withdraw the present bail application. Learned APP for the State, on instructions, does not dispute the said facts.

In view of the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn and disposed of accordingly. Copy of this order be given dasti, as prayed. I.S.MEHTA, J MAY 16, 2017/km
