% 05.12.2017 By order dated 06.02.2017, which is impugned by the petition at hand, passed on the file of civil suit 140/2015 of the respondent (plaintiff), the Additional District Judge declined to accept the written statement of the petitioners (defendants before the trial court) for the reason that they were sought to be submitted with delay of 22 days, there being no application for condonation.

After some hearing, the counsel for the respondent concedes that the written statement may be allowed to be taken on record though insisting that the delay which has occasioned due to neglect may be suitably compensated. On costs of Rs.20,000/-, the prayer is granted. The written statement of the petitioners shall be submitted before the trial court on 08.12.2017, the date already fixed in the CM(M) 599/2017

matter when it shall be taken on record subject to payment of costs. The petition and the pending application are disposed of in above terms.
