O R D E R

% 19.09.2016 Petitioner is aggrieved by certain acts on the part of the respondents. His contention is that the letter of rejection dated 26.05.2016 rejecting his prayer seeking allotment of alternate plot is bad for the reason that the letters dated 03.06.2013 and 31.03.2014 to submit the requisite documents in the Department were not really received by the petitioners.

Record shows that the original owner of the disputed land was Smt. Ram Kaur. She was the owner of land measuring 12 bighas and 9 biswas situated in the Revenue Estate of Village Ghevra, Delhi. This land was acquired vide award dated 09.09.1999. Smt. Ram Kaur applied for an alternate plot on 12.09.2000. She expired on

30.09.2001. Thereafter her legal heirs i.e. her husband, her sons and daughters were pursuing the case.

Contention of the petitioner is that the letter rejecting the prayer made by the legal heirs of Smt. Ram Kaur suffers from an infirmity even the letter dated 26.05.2016 had noted that all documents (except the relinquishment deed) have been furnished by the petitioners to the Department. Further submission is that the afore noted letters requesting for other document (relinquishment deed) has never been received by the petitioners.

Additional submission being that husband of Ram Kaur namely Chander Singh has since expired on 06.03.2016 and a fresh relinquishment deed in favour of Satish Chander, the eldest son of Smt. Ram Kaur will be obtained and positively furnished to the Department within an outer limit of four weeks. Since as even the case of the Department is that all other documents except the relinquishment deed are with the Department, the case of the petitioners on furnishing of the relinquishment deed (within four weeks from today) be considered on merits.

Petition disposed of.
