CRL.M.C. 1849/2017 This is a petition under Section 482 Cr.P.C. read with Article 227 of the Constitution of India for quashing of FIR No.0147/2017, under Sections 323/341/506/34 IPC, registered at Police Station Vasant Kunj (North), New Delhi and all subsequent proceedings emanating therefrom.

Learned counsel for the petitioners submits that the petitioners as well as the respondents No.2 to 4 are residing in the same property i.e. property bearing No.143/9, Kishan Garh Village, Gaushala Road, New Delhi. Counsel further submits that due to the misunderstanding arisen between the parties, a quarrel had taken place between the parties, which resulted into the registration of aforesaid FIR against the present petitioners. He further submits that after the registration of the FIR, the near and close friends intervened in the matter and the misunderstanding arisen between the parties has been sorted out and the dispute has been amicably settled between the parties and the same has been reduced into witting vide settlement deed dated 24.04.2017.

Counsel further submits that since the dispute has been amicably settled between the parties and nothing further remains to be adjudicated, however, the present FIR is coming as hurdle in the peaceful life of the present petitioners and prays that the FIR in question and all proceedings arising therefrom may be quashed. The respondents No.2 to 4/injured-complainant are present in Court today and have been identified by the Investigating Officer, SI Sandeep Sharma, P.S. Vasant Kunj (North), New Delhi and also represented by their counsel Mr.M.P.Bhargava, Advocate. The respondents No.2 to 4 present in person admit that the matter has been amicably settled with the petitioners and the misunderstanding has been sorted out.

They also submit that the said settlement arrived at with the petitioners is voluntary and without any force, pressure or coercion and nothing remains to be adjudicated further between them and that they have no objection, if the FIR in question is quashed.

Consequently, FIR No.0147/2017, under Sections 323/341/506/34 IPC, registered at Police Station Vasant Kunj (North), New Delhi and all subsequent proceedings emanating therefrom are hereby quashed.
