% 29.08.2018 Respondent no.2-Shashi is present in Court along with her counsel, who accepts notice. Respondent no.2 has been identified by ASI Saifuddin of police station Jagat Puri.

Petitioners and respondent no.2 (complainant) are neighbours. It is submitted that with intervention of common friends, matter has been amicably settled between petitioners and respondent no.2 vide Memorandum of Understanding dated 20th August, 2018, therefore, FIR No.440/2011 under sections 420/467/468/ 471/406/506/120B/34 IPC registered at police station Jagat Puri on the complaint of respondent no.2 may be quashed. Affidavit of respondent no.2 to this effect, is on record as Annexure P-4.

Learned APP submits that receipts were forged, therefore, FIR may not be quashed. Learned counsels for the petitioners and respondent no.2 submit that a civil litigation which was pending earlier, has also been settled and in view thereof, petitioners have withdrawn the appeal.

Keeping in mind the above facts, I am of the view that the FIR can be quashed.

Accordingly, interest of justice, in view of the settlement arrived at between petitioners and respondent no.2, aforesaid FIR and the consequent proceedings emanating therefrom are quashed Petition is disposed of in the above terms.
