At the very outset, learned counsel for petitioner submits that, though, the present petition was seeking recalling/quashing of summoning order dated 11.09.2014, however, thereafter the accused was charged vide order dated 08.05.2025 which he challenged by filing a Revision Petition and such Revision Petition has been allowed by the concerned learned Special Judge, Dwarka on 09.12.2025.

He submits that since the accused i.e. petitioner herein has already been discharged, nothing survives in the present petition 3.
Learned counsel for respondent No.2 does admit the abovesaid development but supplements that he has already challenged the abovesaid order dated 09.12.2025.

In view of the above, present petition is disposed of as having become infructuous. However, in case, the abovesaid order dated 09.12.2025 is set aside, the petitioner herein would be at liberty to seek revival of the present proceedings.
