CORAM:
HON'BLE MS. JUSTICE HIMA KOHLI HON'BLE MS. JUSTICE REKHA PALLI
O R D E R
% 11.01.2019 CM APPL. 49708/2018 (by the petitioners/UOI for recall of the order dated 26.09.2018) and CM APPL. 49709/2018 (by the petitioners/UOI for additional documents) 1.
The present applications have been filed by the petitioners/UOI praying inter alia for recalling the order dated 26.09.2018 passed in the writ petition and for hearing the petition afresh on merits. 2.
We may note that the present petition directed against the order dated 23.05.2018 passed by CAT in O.A. No.3310/2016 was listed for admission on 26.09.2018. The previous counsel for the petitioners/UOI, who had filed the writ petition, had addressed arguments for some time but could not persuade this Court to issue notice. At that stage, he had sought leave to withdraw the writ petition. As a result, the writ petition was dismissed as withdrawn.
W.P.(C) 10157/2018
3.
We do not see any reason to recall the said order as it is not a case of dismissal of the writ petition in default, but a case where the writ petition was withdrawn after arguments were addressed on admission. The prayer made in the applications is declined.
4.
The applications are dismissed.
