% 24.08.2018 Respondent no.2-Ms. Divya Ganesan is present in Court along with her counsel and has been identified by SI Kapil of police station Vasant Kunj (North). Respondent no.2 submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Patiala House Courts, New Delhi on 17th April, 2018. She further states that her marriage with petitioner no.1 has already been dissolved by a decree of divorce dated 21st August, 2018 passed by Family Court, Patiala House Courts, New Delhi. Petitioner no.1 has paid `5 lakh to respondent no.2 in the court today vide a demand draft, photocopy whereof has been placed on record.
Respondent no. 2 submits that with this payment, entire
settled amount stands received by her and she has no objection in case FIR no. 52/2017 under Sections 498-A/406/34 IPC registered at police station Vasant Kunj North and consequent proceedings emanating therefrom are quashed against the petitioner no.1 and his relative, that is, petitioner no. 2. Affidavit of respondent no.2, to this effect, is on record.
Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Parties shall remain bound by the terms of Settlement dated 17th April, 2018.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J AUGUST 24, 2018 sm
