CM(M) 891/2016 and CM No. 32909/2016 (stay) By the present petition, the petitioner seeks to impugn the order dated 10.08.2016 by which the warrants of attachment have been issued against the judgment debtor.
Learned counsel appearing for the petitioner submits that the only objection is that the executing court does not have the territorial jurisdiction to issue warrants of attachment against the petitioner Cantonment Board. He submits that an application to that effect filed before the Executing Court has not been gone into.
A perusal of the petition shows that it is bereft of any details. The copy of the execution petition is not filed. It is not known what assets the CM(M) 891/2016
respondent had sought attachment of. Even a copy of the decree is not filed. Hence, it is not known for what amount the decree has been passed. Learned counsel for the petitioner submits that he has instructions to state that the decree has been passed approximately for Rs.2.50 lacs but he is not sure.
It is not clear why the petitioner is not complying with the decree passed by the court and is raising technical pleas in a half hearted manner. There is no merit in the petition. Accordingly, the petition is dismissed. JAYANT NATH, J SEPTEMBER 07, 2016 rb CM(M) 891/2016
