% 08.02.2016 CS(OS) 1518/2015, IA No. 11106, 11107/2015 (u/O 38 R 5 of the CPC and IA No. 1883/2016 u/O XXXVII Rule 2 CPC, all three IAs moved on behalf of plaintiff As per office note, defendant nos.1,2&3 are unserved whereas defendant no.4 was served on second address on 29.10.2015 and vakalatnamas on behalf of defendant nos.1,2&4 were filed. As per office note further, affidavits of service alongwith track report of speed post has been filed as per which defendant no.1 to 3 were served on 05.12.2015 and defendant no.4 was served on 04.12.2015.

Sh. Akhil Mehta, learned proxy counsel for main counsel Mr. Amit Dubey has appeared for defendant no.2 and Mr. Aditya Ranjan, counsel for D-4 have entered their appearances and they have submitted that memo of appearance on behalf of defendant nos. 2&4 have already been filed timely, which is refuted by learned counsel for plaintiff.
