The petitioners impugn summoning order dated 05.09.2014, whereby, the petitioners have been summoned in a complaint filed by the respondent No. 2 alleging an offence under Sections 420/468/34 IPC.

Learned counsel for the petitioners, under instructions from the petitioner, submits that in case directions are issued to the Trial Court to expedite the proceedings, the petitioners would not press the present petition.

In view of the above, the Trial Court is directed to expedite the CRL.M.C. 5460/2014

proceedings and conclude the same, preferably, within a period of one year. The parties shall appear before the Trial Court on 05.09.2018 for directions for fixing an expeditious schedule for disposal of the petition.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.

The petition is, accordingly, dismissed as withdrawn. 6.

It is clarified that this Court has not examined the merits of the contentions of either parties. All rights and contentions of the parties are reserved.
