After arguments, counsel for the appellant does not press the appeal on merits in view of the fact that in the written statement of the appellant/defendant no.3 no claim of tenancy was pleaded and it was only stated that the appellant/defendant no.3 was doing contractual work for RSA No.289/2016

defendant no.1. Counsel for the appellant, however, seeks a period of six months to vacate the suit premises.

In view of the above, while the appeal is dismissed as not pressed on merits, however, the appellant/defendant no.3 is granted time to vacate the suit premises on or before 31.3.2017 subject to the appellant filing an affidavit of undertaking within two weeks from today in this Court that he would vacate the suit premises on or before 31.3.2017 and clear all electricity, water and other charges which are payable with respect to suit premises. On the appellant filing the undertaking and complying with the same, appellant is granted time to vacate the suit premises till 31.3.2017. 4.

Appeal is accordingly disposed of.
