An Application seeking Leave to Appeal under Section 378(3) Cr.P.C has been filed on behalf of the Petitioner against the Judgment of acquittal dated 04.10.2016, passed by Learned ASJ, Karkardooma, Delhi in case FIR No.08/2014 under Section 397/411/34 IPC P.S. AVRS. 2.

It is submitted that the impugned judgment is based purely on conjectures and surmises. The evidence produced by the prosecution has not been considered properly. The learned Trial Court has erred in considering the testimony of PW2 Complainant/injured and that the accused has been correctly identified by the Complainant during the TIP proceedings. A prayer is made that the Leave Petition may be allowed. 3.

In view of the submissions made in the Leave Petition, the same is allowed and stands disposed of accordingly.
