% 12.02.2016 The present petition has been filed by the petitioner for quashing of the order dated 10th October, 2014 passed by the learned Metropolitan Magistrate, vide which the complaint was ordered to be returned in original so that the same may be presented before the concerned Court in whose jurisdiction the drawee bank was situated. The petition came up for hearing before this Court on 15th May, 2015 when notice was issued to the respondent no.2 and proceedings of the Trial Court were directed to be stayed.

Thereafter, the matter remained pending for service.

Learned counsel for the petitioner has submitted that during the pendency of the present petition, an ordinance came into operation and subsequently, now the Act has come into operation by virtue of which the petitioner is required to file the petition at the place where

the cheque was presented. Though the petition was returned to me but it was not presented because of the pendency of the present petition.

Learned counsel for the petitioner wishes to withdraw the present petition with liberty to present the petition before the Court having jurisdiction to try the same.

The petition and application are dismissed as withdrawn with liberty as prayed for.
