% 19.03.2015 CM 20172/2014 & CM 21381/2014 & FAO (OS) 506/2014 We have heard the learned counsel for the parties. The appellant is before us because the arbitrator terminated the proceedings under Section 32(2)(c) of the Arbitration and Conciliation Act, 1996. Both the parties are agreed that the disputes are to be adjudicated through arbitration in terms of the arbitration clause. The learned counsel for the respondent states that the new arbitrator has to be appointed in terms of the existing arbitration clause by the Chief Engineer. The learned counsel states that the Chief Engineer shall appoint the new arbitrator within four weeks. Once the new arbitrator is appointed, the arbitration proceedings shall continue from the stage left-off by the earlier arbitrator. In view of the above directions, the appeal and the applications stand disposed of.
