% 07.11.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.500/2016 under Sections 376/506/109/120B/34 IPC registered at PS Punjabi Bagh.

The allegations of the prosecutrix against the petitioner who was her maternal uncle are that she went to the house of her uncle on 28th June, 2015 and when she was going upstairs to take bath she saw her cousin and the petitioner in an objectionable position where after she was dragged into the room and was raped by the petitioner. Though the subsequent allegations are against the cousin sister and not the petitioner, however in view of the allegations for the incident dated 28th June, 2015 and there is no apparent BAIL APPLN. 1842/2016

cause of enmity between the families, I do not find it to be a fit case for grant of anticipatory bail.

Petition is dismissed.
