% 07.07.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably vide Memorandum of Understanding dated 13th September, 2011. It is further submitted that petitioner and respondent no.2 have resolved their differences and started living together right from September, 2013, therefore, FIR may be quashed. Respondent no.2 is present in Court along with her counsel. She has been identified by SI Sandeep Kumar of police station Subhash Place. She admits having settled the matter with the petitioner and submits that she has joined the company of the petitioner since September, 2013, inasmuch as, three children have also born thereafter.
Keeping in mind that husband (petitioner) and wife (respondent no.2) have resolved their differences and started living together, in my view, no fruitful purpose would be served in keeping the prosecution pending. Accordingly, in the interest of justice, FIR No. 348/13 under Sections 498A/406/34 IPC registered at police station Saraswati Vihar and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
