W.P. (Crl.) 2651/2016 Marital discord between the petitioner no.1 (husband) and respondent no.2 (wife) had led to registration of present FIR against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3 under Sections 498-A/406/34 IPC registered at police station Mukherjee Nagar, on the complaint of respondent no.2.

Petitioner no.1 and respondent no.2 have settled their disputes

amicably before the Mediation Centre, Rohini Courts, New Delhi vide Settlement Agreement dated 25th July, 2015 (Annexure 'C'). Marriage between the petitioner no1 and respondent no.2 has also been dissolved by a decree of divorce by mutual consent on 10th May, 2016 by the Family Courts, West, Tis Hazari Courts, Delhi. Respondent no.2 is present in Court and has been identified by the Investigating Officer, present today. She admits having received entire settled amount and submits that she has no objection in case the FIR is quashed.

Keeping in mind that parties have settled their disputes amicably, no fruitful purpose would be served in keeping the present criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 150/2014 under Sections 498-A/406 IPC registered at police station Mukherjee Nagar and the consequent proceedings emanating therefrom are quashed. Writ petition is disposed of in the above terms. A.K. PATHAK, J.
