% 30.10.2017 Mr. Saurabh Banerjee, learned counsel appearing on behalf of the appellant states that his client would be satisfied in the event the executing court considers granting a set off for a sum of Rs.48,720/-, which he claims is already paid by him to his elder daughter Ms. Drishti Guliani, as detailed in paragraph 18 of the present appeal paper book. Learned counsel appearing on behalf of the respondent states that subject to the verification of the said sum of Rs.48,270/- by the executing court, he would not object to it being set off from the amount owed by the appellant to the respondent, in accordance with law. In view of the foregoing, the executing court before whom the proceedings are pending shall consider the specific details in paragraph 18 of the appeal paper book, in relation to the sum of Rs.48,270/- already stated to be paid by the appellant to his elder daughter Ms. Drishti Guliani, while directing compliance of the order impugned in the present appeal, in accordance with law.

With the above directions, the appeal is disposed off. The appellant is at liberty to move an appropriate application before the court of competent jurisdiction, seeking clarification in relation to the pending applications, annexed to the appeal paper book as Annexure N and Annexure P, in accordance with law.
