% 06.09.2018 Respondent no. 2-Rakhi is present in Court along with her counsel and has been identified by ASI P.N. Subhash of police station Sarita Vihar. Respondent no.2 submits that she has settled the matter with petitioner of her own free will and without any undue force, pressure or coercion vide Memorandum of Compromisation dated 13th November, 2017. Respondent no. 2 further submits that first motion has already been accepted.
Respondent no.2 says she has already received `2.5 lacs out of the settled amount of `3.5 lacs. Petitioner says that balance amount of `1,00,000/- will be paid to respondent no.2 at the time of second motion. Respondent no.2 says that she has no objection in case FIR no. 552/2015 under Sections 498-A/406 IPC registered at Police Station Sarita Vihar is quashed against the petitioner.
Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioner. Petition is disposed of in the above terms. Dasti. A.K.
