% 22.04.2016 Learned counsel for the petitioner informs this Court that on 06.02.2016 the suit filed by the non-applicant/plaintiff has been disposed of; the Trial Court had held that the suit is not maintainable. This petition has become infructous.

Learned counsel for the petitioner, at this stage points out that the question of limitation which has been raised in the application under Order VII Rule 11 of the CPC and which has been dismissed by the order dated 17.3.2015 may be allowed to be re-agitated at the time when any hearing takes place on the legality of the order dated 06.02.2016.

Permission granted.

Petition disposed of in the above terms.
