% 22.09.2016 Present contempt petition has been filed alleging wilful disobedience of the interim order dated 08th July, 2016 passed in Suit No.118/2015 whereby both the parties were directed not to interfere with the electricity and water connection of each other.
In the present petition, it has been averred that despite the aforesaid order, petitioner's electricity and water connection of premises bearing WZ122, second floor, Gali No.7, Shiv Nagar, New Delhi, was disconnected on 06th September, 2016.
In pursuance to the last order passed by this Court, petitioner has now placed on record the order dated 26th August, 2015 by virtue of which petitioner's Suit No.118/2015 was disposed of.
A perusal of the order dated 26th August, 2015 reveals that the said suit was disposed of on the respondent-defendant's undertaking that she would not dispossess the present petitioner from the suit property without following due process of law.
Neither the interim order dated 08th July, 2015 was extended nor incorporated in the statement/undertaking given by the respondentdefendant. Consequently, the present contempt petition premised on the order dated 08th July, 2015 is not maintainable as it has ceased to operate after the final disposal of the suit on 26th August, 2015. Accordingly, present contempt petition is dismissed.
