O R D E R

% 17.10.2016 Petitioner seeks parole for three months on the ground:- (a) To complete the construction of the house and (b) To maintain social ties.

As regards ground of maintaining social ties is concerned, the same is not convincing as petitioner had been released on furlough twice during the current year.

As regards construction of house is concerned, it is not in dispute that it has been partially constructed. Petitioner needs at least 4 weeks time to enable him to complete the construction so that his family

shifts there. Presently, petitioner's family is living in a joint family, where 10 members are stated to be living, that too in a LIG flat. Keeping in mind the totality of facts and circumstances, petitioner is ordered to be released on parole for a period of four weeks from the date of his release, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of Jail Superintendent.

On completion of parole period, Petitioner shall surrender before the Superintendent Jail. It is made clear that in case any other co-convict is out of jail on parole/furlough, petitioner be released only after the other co-convict surrenders in jail. Writ petition is disposed of in the above terms. Copy of the order be sent to the Jail Superintendent for serving it upon the petitioner and for compliance.
